A divided First U.S. Circuit Court of Appeals panel denied the administration’s emergency request to lift an injunction against major parts of President Trump’s mail-ballot executive order. It addressed standing and ripeness, not the merits. The injunction covers only the 23 plaintiff states and D.C. and federal elections on or before Nov. 3, 2026.

The machinery uses two separate systems. The order directs DHS, working with other federal agencies, to compile state-by-state lists of confirmed citizens. Separately, it directs the Postal Service to establish envelope rules and use state-provided mail-in and absentee participation lists when handling ballots. The court expressly says the USPS participation lists are “separate and distinct” from the DHS citizenship lists. Fox News records DOJ’s argument that implementation was unfinished; the majority found election deadlines already imposed costs on states.

The executive approach also has an enforcement dimension. The Washington Examiner reports that DOJ warned election officials about possible criminal charges for knowingly allowing ineligible voting. MishTalk highlights the planned USPS portal for collecting state information about voters eligible to vote by mail and DOJ’s acknowledgment that the separate DHS lists could support investigations or prosecutions of state officials.
